1. Agreement to Terms

By accessing or using the Shyppy platform (available at shyppy.com), operated by Shoham Logistics Ltd ("Shyppy", "we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Description of Service

Shyppy provides a shipment tracking platform that enables users to:

• Track ocean freight containers across major shipping lines
• Track air cargo shipments by Air Waybill (AWB) number
• Track courier and express parcel shipments
• Monitor vessel positions and ETAs
• Access shipment analytics and reporting

Our service aggregates publicly available and API-provided tracking data from carriers and presents it in a unified interface. We do not operate as a freight forwarder, carrier, or logistics provider.

3. Account Registration

To access certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account
• Not share your account with third parties or create accounts for others without authorization

4. Acceptable Use

You agree to use Shyppy only for lawful purposes and in accordance with these Terms. You must not:

• Use the platform to track shipments you do not have authorization to monitor
• Attempt to reverse-engineer, scrape, or extract data from our platform in bulk
• Use automated tools to make excessive API requests or overload our systems
• Interfere with or disrupt the integrity or performance of the platform
• Attempt to gain unauthorized access to any part of the platform or related systems
• Use the service for any illegal purpose or in violation of applicable laws
• Resell or commercially exploit our tracking data without written permission

5. Data Accuracy Disclaimer

Shyppy retrieves tracking information from third-party carrier systems. While we strive to provide accurate and timely data:

• We cannot guarantee the accuracy, completeness, or timeliness of tracking information
• Carrier data may be delayed, incomplete, or temporarily unavailable
• ETAs are estimates based on available data and are subject to change
• We are not responsible for decisions made based on tracking information

Always verify critical shipment information directly with the relevant carrier.

6. Intellectual Property

The Shyppy platform, including its design, code, features, and content, is owned by Shoham Logistics Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without written permission.

Tracking data retrieved from carriers remains the property of the respective carriers. Shyppy grants you a limited, non-exclusive license to use retrieved tracking data for your own internal business purposes.

7. Subscription and Payments

Certain features of Shyppy require a paid subscription:

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by applicable law
• We reserve the right to change pricing with 30 days notice
• Failure to pay may result in suspension or termination of your account
• You are responsible for all applicable taxes on subscription fees

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• Shyppy shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for losses arising from carrier delays, inaccurate tracking data, or service interruptions
• We are not liable for loss of profits, revenue, data, or business opportunities

9. Indemnification

You agree to indemnify and hold harmless Shyppy, Shoham Logistics Ltd, and our officers, employees, and agents from any claims, damages, or expenses arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may cancel your account at any time through your account settings. Upon termination, your right to access the platform ceases immediately.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or platform notice. Continued use of the platform after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Israel. Any disputes arising from these Terms or your use of Shyppy shall be subject to the exclusive jurisdiction of the courts of Israel.
